Welcome to DiscernAI. Please read these Terms of Service carefully before using our application.

1. Acceptance of Terms

By downloading, installing, or using the DiscernAI app, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the app.

2. Description of Service

DiscernAI is an iOS application designed to help users make complex decisions by providing a structured framework for analysis, evaluation, and recommendation. The app leverages Google's Gemini AI to objectively analyze options against criteria, identify pros and cons, and provide personalized recommendations based on your specific situation.

3. Your Account

You are required to create an account to use the app's features. We offer authentication via Email and Sign in with Apple. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to:

• Provide accurate and complete information when creating your account
• Update your information to keep it current
• Protect your account credentials and notify us immediately of any unauthorized use

4. User Content and Data

You retain all rights to the decision data you input into the DiscernAI app. This includes decision titles, descriptions, options, criteria, and weights. By using our service, you grant us a license to use this content solely for the purpose of providing and improving our services, including:

• Transmitting your decision data to Google's Gemini AI for analysis
• Storing your decisions in our Supabase database for synchronization across your devices
• Processing your data to provide personalized recommendations

5. AI Analysis and Processing

The DiscernAI app uses Google's Gemini AI to provide decision analysis and recommendations. By using our service, you understand and agree that:

• Your decision data will be processed by Google's Gemini AI
• While we take reasonable measures to ensure accuracy, AI analyses may not be perfect
• The app is designed to assist with decisions, not make them for you
• You are ultimately responsible for any decisions you make based on the app's recommendations

6. Decision Sharing

DiscernAI allows you to share your decisions with others through secure links. By using this feature, you understand and agree that:

• Anyone with the shared link can view the decision you've shared
• Recipients can create their own copies of your shared decisions
• You can revoke access by disabling sharing for a specific decision
• You are responsible for managing who has access to your shared decisions

7. Data Synchronization

DiscernAI synchronizes your decisions across devices using Supabase. This functionality:

• Stores your decision data in our Supabase PostgreSQL database
• Implements Row-Level Security to protect your data
• Allows you to access your decisions from multiple devices
• Provides offline functionality through local storage with Core Data

8. Privacy and Data Protection

Our Privacy Policy, available in the app and on our website, explains how we collect, use, and protect your personal information. By using DiscernAI, you consent to the data practices described in our Privacy Policy.

9. Prohibited Activities

When using DiscernAI, you agree not to:

• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Attempt to gain unauthorized access to the app or its related systems
• Use the app to transmit viruses, malware, or other harmful code
• Interfere with or disrupt the integrity of the app or its servers
• Attempt to reverse engineer, decompile, or disassemble the app
• Share decisions that contain illegal, harmful, or inappropriate content

10. Limitation of Liability

To the maximum extent permitted by law, DiscernAI and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the app. This includes, but is not limited to, loss of data, loss of profits, or damages resulting from decisions made using the app.

11. Disclaimer of Warranties

The app is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

• The app will be uninterrupted, secure, or error-free
• AI analyses and recommendations will be perfect or meet your specific needs
• Any defects or errors in the app will be corrected

12. Termination

We reserve the right to terminate or suspend your access to the app at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

13. Changes to Terms

We may update these Terms from time to time. The most current version will always be posted on our website. Your continued use of the app after any changes indicates your acceptance of the modified Terms.
